Terms of Service

1. Acceptance of Terms

By accessing or using the Influenced web application, browser extension, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Influenced ("we," "us," or "our"). Please read them carefully.

2. Description of Service

Influenced provides parents and legal guardians with tools to monitor and positively influence the social media algorithms that shape their children's online experience. The Service consists of:

  • Web Dashboard: A web application where parents can manage child profiles, view feed analysis, track influence actions, and manage their account and subscription.
  • Browser Extension:A browser extension that captures social media feed metadata from the parent's browser and enables the parent to take influence actions (such as liking, saving, following, or subscribing to content and creators) on supported platforms.

The Service is designed to work with YouTube, TikTok, and Instagram. Platform support may change over time as third-party platforms update their interfaces and policies.

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that:

  • You are at least 18 years of age.
  • You are the parent or legal guardian of any child whose profile you create within the Service.
  • You have the legal authority to consent to the collection and use of your child's information as described in our Privacy Policy.
  • All information you provide during registration and use of the Service is accurate and truthful.

Children do not create accounts on Influenced. The Service is exclusively operated by parents and legal guardians.

4. Account Registration and Security

To use the Service, you must create an account by providing a valid email address and creating a password. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account, whether or not authorized by you.
  • Notifying us immediately at support@influenced.app if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate your account if we suspect unauthorized access or a violation of these Terms.

5. Acceptable Use

You agree to use the Service only for its intended purpose: monitoring and positively influencing your child's social media experience. You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Create child profiles for individuals who are not your children or legal dependents.
  • Use automated scripts, bots, or other software to interact with the Service beyond the functionality provided by our browser extension.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Circumvent, disable, or interfere with any security or access-control features of the Service.
  • Use the Service to violate the terms of service of any third-party platform (including YouTube, TikTok, and Instagram). You acknowledge that your use of those platforms is subject to their respective terms and policies.
  • Use the Service to harass, stalk, or monitor any individual who is not your minor child or legal dependent.
  • Resell, redistribute, or sublicense access to the Service.
  • Use the Service to collect data for commercial purposes unrelated to the stated functionality.
  • Introduce malware, viruses, or other harmful code through the Service or extension.

We reserve the right to suspend or terminate your account for any violation of this section.

6. Third-Party Platforms

The Service interacts with third-party social media platforms (YouTube, TikTok, Instagram). You acknowledge and agree that:

  • We are not affiliated with, endorsed by, or sponsored by any third-party platform.
  • Third-party platforms may change their interfaces, APIs, or terms at any time, which may affect the functionality of the Service. We are not liable for any loss of functionality resulting from third-party platform changes.
  • Your use of third-party platforms is governed by their respective terms of service and privacy policies.
  • We cannot guarantee the accuracy or completeness of feed data captured from third-party platforms, as platform algorithms and content may change at any time.

7. Subscription and Billing

7.1 Subscription Plans

The Service is offered on a subscription basis. Details of available plans and pricing are displayed on our pricing page and may change from time to time. We will notify existing subscribers of pricing changes at least 30 days before they take effect.

7.2 Free Trial

We may offer a free trial period for new accounts. The trial period, duration, and features included are described at the time of sign-up. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will not be charged during the trial period.

7.3 Recurring Billing

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize us to charge your payment method on file at the start of each billing cycle. All payments are processed through Stripe.

7.4 Cancellation

You may cancel your subscription at any time through the account settings page or via the Stripe Customer Portal. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period.
  • You will not be charged for subsequent billing periods.
  • No prorated refunds are issued for unused time in the current billing period.

7.5 Refunds

We generally do not provide refunds for subscription payments. However, if you believe you have been charged in error, contact us at support@influenced.app within 14 days of the charge, and we will review your request on a case-by-case basis.

7.6 Payment Failures

If a payment fails, we will attempt to process the payment again and notify you by email. If payment cannot be collected after reasonable attempts, we may downgrade or suspend your account. We will provide a grace period before any loss of access to paid features.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, and all other content (excluding user-provided data), is owned by Influenced and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service (including the browser extension) for your personal, non-commercial use in accordance with these Terms. This license does not include the right to:

  • Modify, copy, or distribute the Service or its components.
  • Use the Service or any of its content for commercial purposes beyond personal family use.
  • Remove or alter any copyright, trademark, or other proprietary notices.

Your Data

You retain ownership of all data you provide to the Service (account information, child profile data). We do not claim ownership of your data. We use your data only as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, error-free, or free of harmful components.
  • The results obtained through the Service (including feed analysis and influence action effectiveness) will be accurate, reliable, or complete.
  • The Service will achieve any specific outcome regarding your child's social media algorithm or content exposure.
  • The Service will remain compatible with third-party platforms indefinitely.

Social media algorithms are controlled by third-party platforms and are subject to change without notice. We cannot guarantee that influence actions taken through the Service will produce the desired effect on any platform's algorithm.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INFLUENCED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability shall be limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Influenced and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights or applicable law.
  • Any misrepresentation regarding your parental or guardian status.

12. Termination

You may terminate your account at any time by deleting it through the account settings page. Upon account deletion, all associated data will be permanently removed in accordance with our Privacy Policy.

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or the Acceptable Use policy.
  • Fraudulent or illegal activity.
  • Nonpayment of subscription fees after the grace period.
  • Extended inactivity (accounts inactive for more than 12 months may be subject to deletion after notice).

Upon termination, your license to use the Service immediately ceases. Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law) survive termination.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Notify you by email at least 30 days before the changes take effect for material modifications.
  • Provide a prominent notice within the Service for significant changes.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Influenced regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party platform changes.
